We recently handled a construction accident case where our client fell off a ladder, which wasn’t very high—only about four or five feet off the ground. Despite the relatively low height, he suffered serious injuries. The defendants’ lawyers argued that because the fall was from such a low height, the injuries couldn’t have been significant. However, we were able to demonstrate, through evidence and our client’s doctors, that even a fall from a few feet can be very serious and dangerous, leading to significant injuries. The judge agreed with us, and we successfully established in court that the defendants were responsible for the accident and our client’s injuries.
Construction Fall Settlements We’ve Recovered for Our Clients

How Dangerous are Falls on Construction Sites in New York?
According to data from the Occupational Safety and Health Administration (OSHA), falls are the leading cause of death on construction sites. In 2020, there were 351 fatal falls reported at U.S. construction sites out of a total of 1,008 construction fatalities. In New York City, where construction is constant in all parts of the area and at particularly high heights, workers are in even more danger.

When Is Fall Protection Required on New York Construction Sites?
Regulations help ensure safe workplaces. State law provides construction workers with a number of legal protections. Violations can form the basis of a New York construction fall accident lawsuit.
Labor Laws 200, 240, and 241
New York labor laws ensure a safe work environment for all construction workers and allow workers to hold property owners, contractors, and site managers accountable for injuries on worksites.
- Labor Law 200 states that all worksites and their overseers have a general duty to protect the health and safety of employees. The law requires all construction sites to be constructed, equipped, arranged, and operated to provide reasonable and adequate protection for the lives, health, and safety of workers. It also requires all machinery, equipment, and devices to be properly placed, operated, guarded, and lit to keep workers safe.
- Labor Law 240, also known as the Scaffolding Law, requires that proper safety measures be taken to protect workers around scaffolding, hoists, ladders, and other devices.
- Labor Law 241 requires all contractors, property owners, and agents to comply with specific safety requirements when performing construction, excavation, and demolition work. The law sets requirements for floor support, enclosed elevator shafts, protective barriers, and more.
Building Codes and OSHA Regulations
New York building codes and federal OSHA regulations can also help protect construction workers’ rights if they are injured. OSHA requires that every worker be trained on the proper set-up and use of equipment on the job and know how to recognize hazards. Under OSHA regulations, employers must also provide fall protection equipment for jobs at heights, including ladders, scaffolds, and safety gear like harnesses.
Who Can You Sue in a Construction Fall Accident Lawsuit in New York?
In most construction accident cases, workers cannot sue their own employers–to seek compensation from an employer, a worker would file a claim for workers’ compensation benefits. However, construction fall victims may also be entitled to pursue civil lawsuits against third parties that contributed to their injuries, such as construction site owners or managers, general contractors, or equipment manufacturers. Filing a civil lawsuit against a third party allows injured workers to be reimbursed financially for their injuries and other losses, separately from any workers’ compensation claim.
Types of Compensation Victims May Pursue in a Fall Accident Lawsuit
In a construction accident lawsuit, injured victims and their families may be able to recover compensation for various past and future damages, including but not limited to:
- Pain and suffering
- Medical expenses
- Lost wages
- Lost earning capacity
- Emotional distress
- Rehabilitation costs
